Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Rosely (“Rosely,” “we,” “us,” or “our”) governing your use of the Rosely mobile application and related services (the “Service”). By downloading or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Rosely is a communication and self-reflection tool that offers insights, translations, and suggestions based on attachment-style frameworks. It is provided for personal, informational, and educational purposes only. Rosely is not a substitute for professional advice — including therapy, counseling, medical, or mental-health services — and it does not provide diagnosis or treatment. If you are in crisis or need help, contact a qualified professional or your local emergency services.

2. Eligibility

You must be at least 17 years old to use the Service. By using it, you represent that you meet this requirement and that the information you provide is accurate.

3. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

4. Subscriptions, trials, and billing

Rosely offers auto-renewing subscriptions, which may include:

• A Weekly plan; and
• A Yearly plan, which may include a free trial period (for example, 3 days).

Pricing is shown in the app and may vary by region and over time. The following terms apply to all subscriptions:

• Billing. Payment is charged to your Apple ID account at confirmation of purchase.
• Auto-renewal. Your subscription automatically renews for the same period unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
• Free trial. If you start a free trial and do not cancel at least 24 hours before it ends, your subscription will begin and you will be charged the applicable price. Any unused portion of a free trial is forfeited when you purchase a subscription.
• Managing & canceling. You can manage or cancel your subscription in your Apple ID account settings. Deleting the app does not cancel your subscription.
• Refunds. Purchases are processed by Apple and are subject to Apple's refund policies. We generally cannot issue refunds directly.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful, harmful, or abusive purpose;
• Copy, modify, reverse-engineer, or create derivative works from the Service;
• Attempt to gain unauthorized access to the Service or interfere with its operation;
• Use the Service to harass, threaten, or harm others.

6. Intellectual property

The Service, including its content, design, text, graphics, and software, is owned by Rosely and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial use, subject to these Terms.

7. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that its insights will be accurate or suitable for your situation.

8. Limitation of liability

To the maximum extent permitted by law, Rosely and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, relationships, or goodwill, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim.

9. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or for any other reason. You may stop using the Service at any time.

10. Apple-specific terms

If you use the Service on an Apple device, you acknowledge that these Terms are between you and Rosely only, not Apple, and that Apple is not responsible for the Service or its content. Apple is a third-party beneficiary of these Terms and may enforce them against you. The license granted is also subject to the usage rules in Apple's App Store Terms of Service (Apple's standard Licensed Application End User License Agreement).

11. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12. Governing law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Wyoming.
